N‑able Technologies Ltd. and our affiliated companies and subsidiaries (“N‑able,” “we,” “us” or “our”) are committed to privacy, security, and transparency. This document (the “Privacy Notice”) describes personal information we collect about you, how we use or disclose it, your rights related to your personal information, and how we secure information. “Personal information” means information that identifies, directly or indirectly, you or can be used to identify you as an individual.

This Privacy Notice applies to personal information collected, used or, or shared by on behalf of N-Able, including information collected through our website at www.n-able.com (the “Site”), by email, phone, at an event or other offline method, or any other service or interface where this Privacy Notice is displayed (collectively referred to herein as “N-able Services”). Additional terms and conditions may also apply to your relationship with N-able depending on how you choose to interact with us. For example, personal data we process on behalf of our customers is governed by our Software Services Agreement and Data Processing Addendum; all applicants for employment agree to our applicant privacy notice; and all our employees agree to an employee privacy notice.

Please read this entire policy to make sure you fully understand it. You should also carefully review other terms applicable to any N‑able Services you use and confirm that you understand and agree to them before you begin using any N‑able Services. Unless otherwise noted, N‑able is the controller of information collected pursuant to or referenced in this Privacy Notice.

Privacy-Related Requests

As described in more detail in this Privacy Notice, you may have the right to submit requests for information access, correction, or deletion, or any other privacy-related request, by contacting us at [email protected]. We will process your request in accordance with applicable privacy laws and may ask you for additional information to verify your identity.

Information We Collect

In order to continually improve the N‑able Services, we collect information as part of our normal business operations and in the administration of business relationships as follows:

Business Contact and Customer Relationship Management. We collect and maintain information provided to us by business contacts, which may include company name, contact name and title, phone number, email, and other contact details.

Data Submitted through N‑able Services. You may be prompted to provide certain information to us when interacting with the N‑able Services:

  • By completing forms on our Site, by providing us with your information at trade shows or other events, or anywhere else we conduct business
  • By downloading documentation related to N‑able Services
  • By subscribing to emails or other communications
  • By corresponding with us by phone, e-mail, or otherwise contacting us

Site Usage Details. We collect information about usage of N‑able Services, including IP address, email address, and usage statistics. When you visit our Site, we automatically collect certain browser or device-generated information, including but not limited to:

  • Your domain
  • Your IP address
  • The date, time, and duration of your visit
  • Your browser type
  • Your operating system
  • Your page visits
  • Other information about your computer or device (e.g., device type, browser resolution)
  • Information related to website visits/traffic

Third Party Data. We may also obtain information about business contacts from third parties unless prohibited by applicable law, including third parties from whom we have purchased information, public databases, resellers, channel partners, and marketing partners. We may combine this information with information provided by you. This helps us to update, expand, and analyze our records, identify new customers, and create more tailored advertising to provide N‑able Services that may be of interest.

Aggregate and De-identified Data. We may de-identify and aggregate certain information we collect such that the information no longer identifies or can be linked to a particular individual or customer, subject to the terms of any applicable agreements. We may use this information to improve N‑able Services, analyze trends, publish market research, and for other marketing, research, or statistical purposes, and may disclose such data to third parties for these specific purposes.

How We Use Information

In this section, we explain the purposes for which we use information.

Purposes of Collection and Processing. The purposes for which we may process information vary depending upon the circumstances. Generally, we use for the information we collect for the following business and commercial purposes:

  • Operating N‑able Services and providing related support: to provide and operate the N‑able Services, communicate with you about your use of N‑able Services, provide troubleshooting and technical support, fulfill your orders and requests, process your payments, communicate with you, and for similar service and support purposes
  • Responding to requests: to respond to your inquiries and requests or otherwise communicating with you
  • Analyzing and improving N‑able Services: to better understand how you access and use N‑able Services, in order to administer, monitor, and improve N‑able Services, for our internal purposes, and for other research and analytical purposes
  • Personalizing experiences: to tailor content we may send or display on our websites, to offer location customization and personalized help and instructions, and to otherwise personalize your experiences
  • Advertising and marketing: to promote N‑able Services on third party websites, as well as for direct marketing purposes, including information that may interest our customers
  • Protecting our legal rights and preventing misuse: to protect our business operations; to prevent, detect and investigate fraud, misuse, harassment or other types of unlawful activities; when necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party; or to prevent violations of this Privacy Notice and our applicable agreements
  • Complying with legal obligations: to comply with the law or legal proceedings. For example, we may disclose information in response to subpoenas, court order, and other lawful requests by regulators and law enforcement, including responding to national security or law enforcement disclosure requirements.
  • Related to our general business operations: to consider and implement mergers, acquisitions, reorganizations, and other business transactions, and where necessary to the administration of our general business, accounting, recordkeeping and legal functions.

Aggregated and Anonymized Data. We may also use aggregated and anonymized data to improve and develop our products and services and for related research and analytics purposes.

How We Share Information

We do not sell personal information to any third party. We share personal information only as described in this Privacy Notice and with subsidiaries N‑able controls that either are subject to this Privacy Notice or follow practices that are at least as protective. We also engage third party service providers who operate pursuant to our instructions to assist us with conducting and managing our business. N‑able may share your information with these affiliates and third parties to perform services on N‑able’s behalf, subject to appropriate contractual restrictions and security and privacy measures.

In general, we may disclose information as follows:

  • Customers: if you use, access or communicate with us about N‑able Services on behalf of your company who is our customer, we may share information about your access and your communications or request with the relevant customer
  • Service providers: to third party service providers who perform functions on our behalf. Third party service providers will only process your information in accordance with our instructions and will implement adequate security measures to protect your information
  • Advertising and analytics partners: to third parties we engage to provide advertising, campaign measurement, online and mobile analytics, and related services to us (with your consent, where required by applicable laws)
  • In response to legal process: in order to comply with the law, judicial proceedings, a court order, or other legal process, such as in response to a subpoena
  • To protect our rights: where we believe it is necessary to investigate, prevent, or take other action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Privacy Notice, and in responding to any claims asserted against us
  • Business transfers: as part of any merger, sale, and transfer of our assets, acquisition, or restructuring of all or part of our business or similar event, including related to due diligence conducted prior to such event
  • Aggregate or Anonymous Data: We also may share aggregate, anonymous, or de-identified data with third parties for research, analytics, and other purposes, provided such information does not identify an individual

Other Data

We also process information we receive in our role as service provider for customers who use the N‑able Services. Our customers’ respective privacy policies apply to and govern the processing of their information, not this Privacy Notice; any requests related to information we process on behalf of our customers should be directed to the customer. Our customers’ privacy and security practices are their own and may differ from those described in this Privacy Notice.

Additional Information for EEA, Swiss and UK Residents

If you are a European Economic Area (EEA), Swiss or United Kingdom (UK) resident, you may have the right to access your information, the right to correct your information, the right to request deletion of your personal information, the right to request restricted processing of your personal information, the right to a portable copy of the personal information you have provided, and the right to object to processing of your personal information, such as for direct marketing. EEA, Swiss and UK residents also have the right to lodge a complaint with a data protection authority if they have concerns about N‑able’s handling of personal information.

Legal Bases. Certain laws, including the General Data Protection Regulation (Regulation (EU) 2016/679) (GDPR)require that we inform you of the legal bases for our processing of your personal information. We process personal information for the following legal bases:

  • Performance of contract: information processing is necessary to perform a contract with you or take steps to enter into a contract at your request
  • Compliance with law: information processing is necessary to comply with a relevant legal obligation (for example, laws that require us to collect tax information from customers, verify certain information relative to customers, or that compel us to disclose information to public authorities or regulators)
  • Defense of our rights: information processing is necessary to the establishment, exercise or defense of legal claims
  • With your consent: you have consented to information processing (for example, where we are required by local law to rely upon your prior consent for the purposes of direct marketing)
  • Our legitimate interests: information processing is in our legitimate business interests and helps us conduct and develop business, subject to your interests and fundamental rights

The majority of any information processing referenced in this Privacy Notice is based on a legitimate interest. In all cases where legitimate interests are relied upon as a lawful basis, we take steps to ensure that our legitimate interests are not outweighed by any prejudice to your rights and freedoms. This is achieved in a number of ways, including the application of principles of data minimization and security, and taking steps to ensure that information is collected where it is relevant and for lawful business activities, and that it is reasonably necessary for those activities.

International Transfers of Information

N‑able is a company that operates around the world. By using the N‑able Services, you acknowledge and agree that your information may be processed outside your country of residence, including in other jurisdictions (like the United States) that may have different data protection frameworks than your region. We may also need to transfer your information to provide N‑able Services to you in accordance with our existing agreements with you, such as the Software Services Agreement.

We’ve implemented and maintain a framework consistent with applicable law and this policy for transfers of information outside the country of collection. For example, when we transfer personal data collected in the EEA, Switzerland or UK to locations outside the EEA, Switzerland, or the UK, we rely on transfer mechanisms to help establish adequate safeguards, like Standard Contractual Clauses which have been approved by the European Commission, and the UK Addendum.

Children

N‑able Services are not for persons under the age of 16 years and N‑able does not knowingly collect, store, share or use the information of children under 16 years. If you are under the age of 16 years do not provide any information to N‑able, even if prompted to do so. If you are under the age of 16 years and you have provided information, ask your parent(s) or guardian(s) to notify N‑able and we will delete all your information. If you are aware that any children under the age of 16 years has given us information, please contact us at [email protected] so that we can delete it.

Marketing

Where lawful to do so, and subject to the required consent, we may communicate with customers (and related business contacts) about N‑able Services. You may unsubscribe from marketing communications by emailing us at [email protected]. We may continue to send you transactional or service-related communications, such as service announcements and administrative messages related to the N‑able Services you use.

Retention of Information

We generally keep information for as long as necessary to fulfill the purposes for which it was collected. In some circumstances, however, we may retain information for other periods of time, including where we are required to do so in accordance with legal, tax, security, and accounting requirements or if required to do so by a legal process, legal authority, or other governmental entity capable of making this request.

In specific circumstances, we may also retain information for longer periods of time, which may correspond to a statute of limitations, so that we have an accurate record of your dealings with us in the event of any complaints or challenges.
